This Indenture made the last day of February in the year of the reign of our Sovereign Lord James by the Grace of God King of England-Scotland France and Ireland Defender of the Faith etc. (that is to say) of England France and Ireland the l8th And of Scotland the four and fiftyth Between Sir John Jephson of Froyle in the co. of Southton Knight on the one part And Henry Lucas the elder of Froyle aforesaid gent on the other part Witnesseth that the said Sir John Jephson as well in consideration that the said Henry Lucas hath before the ensealing hereof surrendered and yielded up unto him the said Sir
John Jephson an Indenture of Lease bearing date the fifth day of October in the year of the reign of the said Sovereign Lord King James of England France and Ireland the seventh and of Scotland the three and fortith made and granted by Sir William Jephson Knight deceased Brother of the said Sir John unto the said Henry Lucas of the messuage farm and other things hereinafter mentioned for the term of four score and nineteen years from the feast of St Michael the Archangel which was in the year of our Lord God one thousand six hundred and nineteen (if Elizabeth Lucas wife of the said Henry and William Lucas and Henry Lucas sons of the said Henry Lucas or any of them should so long live) and for and in consideration of the sum of £200 of lawful money of England heretofore paid into the said Sir William Jephson by the said Henry Lucas before the ensealing and delivery of the said Indenture of Lease therein mentioned as for divers other good causes and considerations given the said Sir John Jephson herewith especially moving Hath demised granted betaken and to farm let And by these presents doth demise grant betake and to farm let unto the said Henry Lucas has exors admins and assigns All that messuage and farm commonly called or known by the name of Banburies situate lying and being in Froyle aforesaid together with all and singular houses edifices barns stables buildings backsides orchards gardens dovehouses lands tenements meadows pastures feedings commons commodities and profits advantages and heriditaments whatsoever to the said messuage and farm belonging or appertaining or therewith all or with any part thereof demised used occupied of enjoyed To Have and To Hold the said messuage and farm called Banburies and all and singular the premises with their and every of their appurtenances unto the said Henry Lucas his exors admins and assigns from the date of these presents unto the full end of term of four score and nineteen years from hence next ensuing fully to be complete and ended (if the said Elizabeth Lucas wife of the said Henry Lucas and the said William Lucas and Henry Lucas sons of the same Henry Lucas the elder or any of them the said Elizabeth Lucas William Lucas and Henry Lucas the son do or shall so long live) yielding and paying therefore yearly and every year during the continuance of the tenure by these presents demised unto the said Sir John Jephson his heirs and assigns the sum of fifty and one shillings of lawful money of England At two feasts or Terms in the year (that is to say) At the feast of the Annunciation of the Blessed Virgin Mary and St Michael the Archangel by even and equal portions And the said Sir John Jephson doth for himself his exors admins and assigns and for every of them covenant and grant to and with the said Henry Lucas the elder his exors admins and assigns and every of them by these presents in manner and form following (that is to say) That he the said Henry Lucas the elder his exors admins and assigns and every of them shall and may from time to time and at all times hereafter during the term hereinbefore mentioned to be hereby granted under the rent covenants conditions and agreement herein contained peaceably and quietly have hold occupy possess and enjoy All the said messuage and farm lands and all and singular other the premises hereinbefore mentioned to be hereby demised with the appurtenance and every part and parcel thereof without the let suite molestation disturbance or eviction of the said Sir John Jephson his heirs assigns or any of them and without the lawful let suite molestation disturbance or eviction of any other person or persons whatsoever lawfully claiming or which shall hereafter lawfully claim any estate title or interest in to or out of the premises or any part or parcel thereof from by or under him them or any of them or by from or under the said Sir William Jephson Knight deceased or by them or with their or any of them means estate act title assent consent privity or procurement And also that it shall and may be lawful to and for the said Henry Lucas the elder his exors admins and assigns and to and for every of them during the continuance of the said tenure hereby granted to have and take in and upon the premises without making any waste spoil or destruction sufficient and necessary house boote fireboote hedgeboote ploughboote and cartboote at all seasonable and convenient times in the year and as often as need shall require the same to be employed and bestowed in and upon the before demised premises and not elsewhere Saving that for and during so long time of the said tenure as they the said Henry Lucas the elder and Elizabeth his wife or either of them do or shall inhabit or dwell in any other house within the said parish of Froyle it shall and may be lawful to and for them the said Henry Lucas and Elizabeth and either of them to have and to take in and upon the premises competent and sufficient fireboote to be expended at such other house which they or either of them for the time being do or shall so inhabit or dwell in the same parish And the said Henry Lucas the elder doth for himself his exors admins and assigns covenant and grant to and with the said Sir John Jephson his heirs and assigns by these presents That the said Henry Lucas the elder his exors admins and assigns and every of them shall and will from time to time and at all times during the continuance of the tenure or interest by these premises demised well and sufficiently repair uphold maintain and keep all and singular the before demised premises and every part and parcel thereof in all needful and necessary reparations and the same so well and sufficiently repaired maintained upheld and kept shall in the end of the term aforesaid leave and yield up unto the said Sir John Jephson his heirs or assigns
