This Indenture made 8th day of April in the 14th year of the reign of Charles Second Between John Fiennes of Froyle in the County of Southampton Esq Lord of the Manor of Froyle and Husseys in the same County of the one part and Jerome Christmas of Bensted in the same County of Southampton yeoman of the other part Witnesseth that the said John Fiennes as well for in consideration that the said Jerome Christmas hath by his deed bearing date the unto the said John Fiennes his heirs and assigns for ever All the right title interest claim and demand whatsoever the said Jerome Christmas his heirs now hath and hereafter may have or claim of in or to any Common or Commons whatsoever within the said Manor of Froyle and Husseys or either of them being within the parish of Froyle or belonging unto the said Jerome Christmas his heirs assigns for or in respect or appertaining to his messuage and tenement and one yard land and half yard land held of the said Manor of Froyle by copy of Court Roll by one John Dearinge and to his messuage and tenement and one yard land held of the said Manor of Froyle by copy of Court Roll by one John Godson and of his Common of Pasture for 30 sheep belonging unto half a yard land sold by Sir John Jephson unto Sir Humfry Maye as for divers other goods causes and considerations him the said John Fiennes thereunto especially mentioned Hath granted bargained sold ……….. by these presents doth grant bargain sell ……… confirm unto the said Jerome Christmas and to his heirs and assigns …….. All that part and parcel of land lately enclosed out of certain Common in Froyle called Brockall Common containing by estimation 45 acres (be it more or less) as it is newly enclosed and set out lying between a coppice called Sheephouse Coppice on the North a parcel of land called Hiveham on the West a parcel of land called Marhill on the East And a field called Barrland field on the South And also the said John Fiennes by and with the consent of Robert Rowte of Froyle aforesaid yeoman witness by his hand and seal hereunto set and subscribed hath likewise granted bargained sold ……….. and confirmed And by these presents doth grant bargain sell …… and confirm unto the said Jerome Christmas his heirs and assigns foreverAll that part and parcel of land newly enclosed out of the said common called Brockall containing by estimation seven acres (be it more or less) allotted and set out for and in part of the Common belonging unto a messuage or tenement of land of the said Robert Rowte and lieth between the said coppice called Sheephouse Coppice on the North the said Common on the east a close of land of William Newman and Nicholas Ede’s newly enclosed out of the said Common on the west and south And all tithes of Corn Grain and Hay and other great Parsonage tithes which shall at any time hereafter happen arise increase or grow due out of and from all and singular the said parts and parcels of lands and premises abovementioned lately enclosed out of the said common or commons or of any part thereof And also all the right tithe interest claim and demand whatsoever of him the said John Fiennes of into and out of all and singular the said part and parcel of lands and. Premises abovementioned And of into or out of the said tithes thereupon growing and arising To Have and to Hold all and singular the said parts and parcels of lands tithes and premises with the appurtenances hereby granted bargained sold or leased or mentioned or intended to be hereby granted bargained sold or released as aforesaid and every part parcel thereof unto the said Jerome Christmas his heirs executors administrators and assigns and for every of them doth covenant promise grant and agree for which the said Jerome Christmas his heirs executors administrators and assigns and for which every of them for ever by these presents that he the said Jerome Christmas his heirs and assigns shall and lawfully may for ever hereafter peaceably and quietly have hold use occupy possess and enjoy the said several parts and parcels of land tithes and premises above mentioned or intenated to be hereby granted bargained sold or released and every part and parcel thereof with the appurtenances without any manner of lawful lett suite trouble hindrance molestation eviction ……. interruption contradiction or disturbance of the said John Fiennes his heirs and assigns or of any tenant tenants farmer or farmers or occupier or occupiers of any of the copyhold customary or demesne land belonging to the said Manors of Froyle and Husseys or to either of them And That the said John Fiennes his heirs and assigns and all and every other person or persons whatsoever lawfully claiming from by or under him them other or any of them shall and will at any time within the space of 20 years next ensuing the date hereof at the reasonable bequest and at the proper costs and charges in the law of him the said Jerome Christmas or his heirs or assigns make do acknowledge levy execute and suffer or cause to be made done acknowledged levied executed and suffered all and every such further and other lawful and reasonable act and acts thing and things devise and devises assurance and assurances in the law whatsoever for the further better and more perfect assurance surety and more suremaking of the said several parts and parcels of lands tithes and premises before by these presents granted bargained or released or mentioned or intended to be hereby granted bargained sold or released and every part and parcel thereof with the appurtenances unto the said Jerome Christmas his heirs and assigns for ever Be it by fine or fines feoffment or feoffments recovery or recoveries release or confirmation or by any of the said ways or means or by any other ways or means whatsoever as he the said Jerome Christmas his heirs or assigns or his or their counsel learned in the laws shall be reasonably devised advised thought meet or required All which said fines feoffments recoverings releases confirmations and other assurance so to be had and made as aforesaid shall be and ensure and shall be adjudged deemed and construed and taken to be and ensured to the sole only and proper use and behoof of the said Jerome Christmas his heirs and assigns for ever In Witness whereof the parties first above named to these present indentures interchangeably have set their hands and seals the day and …………..
