Indenture between William Wither & Hon John Fiennes 1657

This Indenture made the day of January in the year of our Lord according to the account now used in England one thousand six hundred and fifty and seven between William Wither of in the County of Southampton Esq who intermarried with Joan one of the daughters and coheiresses of Thomas Geale late of Alton in the said County Esq Malachy Dudney of Upton Grey in the said County gent who intermarried with Barbara the other daughter and coheiress of the said Thomas Geale and Lawrence Geale of Alton in the said County of Southton gentleman and Daniel Butler of aforesaid yeoman exor of the last will and testament of Thomas Geale aforesaid Esq deceased of the one part and the Hon John Fiennes of Froyle in the said County of Southton Esq of the other part Witnesseth that the said William Wither Malachy Dudney Lawrence Geale and Daniel Butler as well for and in consideration of the sum of £340 of lawful money of England do them the said William Wither Malachy Dudney Lawrence Geale and Daniel Butler in hand paid by the said John Fiennes before the ensealing and delivery of these presents the payment and receipt whereof the said William Wither Malachy Dudney Lawrence Geale and Daniel Butler do hereby acknowledge and thereof and of every part and parcel thereof do fully thereby and absolutely acquit release exonerate and discharge the said John Fiennes his heirs exors and assigns each and every of them for ever by these presents As for divers other good causes and considerations then thereunto especially moving Have remitted and released and for ever quit claimed and discharged and by these presents do remit release and for ever quit claim and discharge unto the said John Fiennes his heirs and assigns for ever All the estate right tithe claim and demand whatsoever which the said William Wither Malachy Dudney Lawrence Geale and Daniel Butler their heirs and assigns any or either of them ………. land or hereafter mayor might have or lawfully claim as appurtenances aforesaid or by any other ways or means Whatsoever in or to or out of All that Messuage or tenement barns stables and buildings with the orchards gardens and backsides profits and appurtenances thereof or thereunto belonging called or known by the name of Banburys Farm or by whatsoever name or names the said is called or known situate lying and being in the parish tithing or Lordship of Froyle in the County of Southton aforesaid and now or late in the tenure or occupation of one Samuel Winslade his undertenants or assigns together also with all closes lands and hereditaments to the said Messuage or tenement belonging or appertaining and containing by estimation ninety and three acres be the same more or less and namely one close or parcel of ground called Banburys Down and other close called Barn Close the backside one close called the Lower Sale another called Sale Wood and other close called Broadnam and other close called Heath Close one meadow about half an acre one piece of coppice and wood about six acres in the field called Neatefield about eleven acres and in Butterfield one acre and also all ways ……..  sheep walks commons profits and commodities whatsoever with the appurtenances to the said messuage lands and premises belonging or appertaining or therewith usually held letter or demised he the said John Fiennes being in full quiet and peaceable possession of the said premises that they the said William Wither Malachy Dudney Lawrence Geale and Daniel Butler and every of them from having or claiming any late right title or interest claim or demand whatsoever from henceforth for ever hereafter shall be fully and wholly sethided or debarred In Witness whereof the parties above said unto these present Indenture interchangeably have set their hands ………..
